Contenva (“Contenva”, “we”, “us”, “our”) respects the privacy and protection of personal information belonging to customers, prospective customers, website visitors, suppliers, partners, contractors, employees, service providers and other individuals with whom we interact.
This Privacy and Personal Information Processing Policy explains how Contenva processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”), applicable regulations and other applicable South African laws.
POPIA regulates the processing of personal information by public and private bodies and establishes conditions for lawful processing.
By using our website, submitting information to us, creating an account, purchasing products or services, requesting a quotation, subscribing to communications or otherwise interacting with Contenva, you acknowledge that your personal information may be processed as described in this Policy, subject to your rights under applicable law.
2. WHO IS RESPONSIBLE FOR YOUR PERSONAL INFORMATION?
For purposes of POPIA, Contenva may act as the Responsible Party in relation to personal information that we determine the purpose and means of processing.
Where Contenva appoints another organisation to process personal information on our behalf, that organisation may act as an Operator.
Operators may include, depending on the services actually used by Contenva:
- website hosting providers;

- WooCommerce and WordPress service providers;

Contenva will take reasonable steps to ensure that Operators process personal information in accordance with applicable legal requirements and our instructions.

Contenva is committed to processing personal information in accordance with the eight conditions for lawful processing under POPIA:
- Accountability;

- Purpose specification;

- Information quality;
- Openness;
- Security safeguards; and
- Data subject participation.
We will not intentionally collect or process personal information in a manner inconsistent with POPIA.

6. CHILDREN’S PERSONAL INFORMATION
Contenva does not knowingly collect personal information from children in circumstances where POPIA prohibits such processing.
Where personal information relating to a child is required for a legitimate business purpose, Contenva will process it only where permitted by POPIA, including where the necessary consent or other lawful basis exists.

Contenva will process personal information only where a lawful basis exists.

9.1 Consent
You may voluntarily consent to the processing of your personal information for a specified purpose.
Where consent is used, you may generally withdraw your consent, subject to legal or contractual limitations.

Processing may be necessary to:
- enter into a contract with you;

10. INFORMATION COLLECTED DURING ONLINE PURCHASES
When you purchase products or services through Contenva’s website, we may process:
- customer name;
- contact information;
- billing details;
- delivery details;
- order information;
- product information;
- payment status;
- transaction reference;
- invoice information; and
- other information necessary to complete the transaction.
Payment-card information should generally be processed directly by the relevant payment service provider rather than stored unnecessarily on Contenva’s systems.
Depending on the payment methods enabled on the website, transactions may involve third-party payment providers.
Examples may include card-payment systems, PayPal, PayFast, bank-payment systems, Stitch, Visa-related payment infrastructure or other providers actually enabled by Contenva.
The relevant provider’s own privacy policy may also apply.
11. PAYMENT INFORMATION
Contenva may use third-party payment providers to process payments.
Contenva will not intentionally request or store payment-card information beyond what is reasonably required for legitimate payment processing and administration.
Payment providers may process information according to their own legal terms, security requirements and privacy policies.

Where required, Contenva will provide appropriate information and controls concerning non-essential cookies.
You may also configure your browser to refuse or delete cookies. However, disabling certain cookies may affect website functionality.
13. GOOGLE ANALYTICS AND SIMILAR SERVICES
Contenva may use analytics services such as Google Analytics or similar technologies to understand how visitors interact with the website.
These services may collect technical and usage information and may use cookies or similar identifiers.
Where such services involve the transfer or processing of personal information outside South Africa, Contenva will consider the requirements of POPIA relating to cross-border transfers.
14. MARKETING COMMUNICATIONS
Contenva may send marketing communications concerning:
- Contenva products;
- services;
- events;
- promotions;
- educational content;
- digital products;
- business opportunities;
- newsletters;
- partner offers; and
- other relevant information.
Direct marketing by electronic communication is specifically regulated by section 69 of POPIA. POPIA generally prohibits electronic direct marketing unless the required consent exists or the statutory customer exception applies.
Contenva will therefore seek to ensure that electronic direct marketing is sent only where legally permitted.
Every applicable marketing communication should provide an appropriate mechanism to unsubscribe or opt out.
You may also contact Contenva to request that marketing communications stop.
15. CUSTOMER MARKETING
Where you are an existing customer, Contenva may process your contact information for direct marketing where the requirements and exceptions under POPIA are satisfied.
Where consent is required, Contenva will obtain it in an appropriate manner.
The Information Regulator’s current guidance emphasises that POPIA protections continue to apply to electronic direct marketing and that consent must be meaningful and informed where required.
16. AFFILIATE MARKETING
Contenva may participate in affiliate marketing programmes.
Affiliate links may allow third-party networks to recognise that a visitor arrived at a third-party website through Contenva.
Where affiliate technologies use cookies or similar identifiers, Contenva will provide appropriate disclosure and comply with applicable legal requirements.
Affiliate partners may have their own privacy policies and terms.
17. SOCIAL MEDIA

You should review the applicable platform’s privacy policy.

Contenva may use artificial intelligence, automation and software tools to improve:
- customer service;

- content production;
- administration;
- website operations;
- business analysis;
- workflow management;
- productivity;
- technical support; and
- other business processes.
Contenva will take reasonable measures to avoid unnecessarily submitting personal information to AI systems.
Where third-party AI or automation services process personal information on behalf of Contenva, Contenva will consider the relevant POPIA requirements, contractual safeguards, security measures and cross-border processing implications.
Personal information will not knowingly be used for automated decision-making in a manner prohibited by section 71 of POPIA.
Section 71 places restrictions on decisions producing legal consequences or substantial effects when based solely on certain automated processing.
19. AUTOMATED DECISION-MAKING
Contenva may use automated systems for ordinary business functions such as:
- spam detection;
- fraud detection;
- website security;
- transaction processing;
- analytics;
- workflow automation; and
- customer-service assistance.
Contenva will not intentionally subject a data subject to a prohibited decision producing legal consequences or substantial effects based solely on automated processing where POPIA prohibits such processing.
20. THIRD-PARTY SERVICE PROVIDERS
Contenva may share personal information with service providers where reasonably necessary.
These may include:
- hosting companies;

Contenva may disclose personal information where disclosure is:
- required by law;
- required by a court;
- required by a regulatory authority;
- necessary to investigate unlawful activity;
- necessary to protect rights or property;
- necessary to prevent fraud;
- necessary to enforce an agreement; or
- otherwise permitted by law.
22. CROSS-BORDER TRANSFERS
Contenva may use international technology and service providers.
Consequently, personal information may in some circumstances be processed or stored outside South Africa.
POPIA section 72 regulates transfers of personal information outside South Africa. Appropriate conditions must be satisfied before personal information is transferred internationally, including adequate protection, appropriate contractual protections, consent or certain contractual/other lawful circumstances.
Contenva will take reasonable steps to ensure that applicable cross-border processing complies with POPIA.
23. INFORMATION SECURITY
Contenva will implement reasonable technical and organisational safeguards appropriate to the risks associated with personal information.
Security measures may include:

A security compromise may include:
- unauthorised access;
- unauthorised disclosure;
- loss;
- theft;
- destruction;
- alteration;
- accidental disclosure;
- cyberattack; or
- another compromise of personal information.
POPIA requires responsible parties to notify the Information Regulator and affected data subjects where a security compromise occurs, as soon as reasonably possible after discovery. The Information Regulator currently states that there is no low-risk exemption from reporting and that security compromises must be reported.
Contenva will maintain an incident-response process designed to:
- identify the incident;
- contain the incident;
- assess affected information;
- investigate the incident;
- mitigate potential harm;
- notify relevant internal personnel;
- notify the Information Regulator where required;
- notify affected data subjects where required;
- document the incident; and
- implement corrective measures.
The Information Regulator currently provides an eServices process for security-compromise notifications.
25. INFORMATION QUALITY
Contenva will take reasonably practicable steps to ensure that personal information in our possession is:
- accurate;
- complete;
- not misleading;
- updated where necessary; and
- relevant to the purpose for which it is processed.
You should notify Contenva when your personal information changes.
26. DATA RETENTION
Contenva will retain personal information only for as long as reasonably necessary for the purpose for which it was collected, unless a longer retention period is required or permitted by law.
Retention periods may depend on:
- the nature of the information;
- the purpose of processing;
- contractual obligations;
- tax requirements;
- accounting requirements;
- legal obligations;
- dispute resolution;
- security requirements;
- legitimate business requirements; and
- applicable limitation periods.
When personal information is no longer required, Contenva will take reasonable steps to securely delete, destroy or anonymise it where appropriate.
27. YOUR RIGHTS AS A DATA SUBJECT
Subject to applicable legal limitations, you may have the right to:
27.1 Access

27.3 Deletion
Request deletion or destruction of personal information where legally appropriate.

27.6 Direct marketing objection
Object to the processing of personal information for direct marketing purposes.
27.7 Complaint
Lodge a complaint concerning alleged interference with your personal-information rights.
The Information Regulator confirms that data subjects have rights including access, correction/deletion, objection, withdrawal of consent and notification of security compromises.
28. HOW TO REQUEST ACCESS OR CORRECTION
A request should contain sufficient information to enable Contenva to identify:
- the requester;
- the information concerned;
- the nature of the request; and
- any information reasonably necessary to verify identity.
Requests may be subject to applicable legal requirements and reasonable identity-verification measures.
29. IDENTITY VERIFICATION
To protect personal information, Contenva may require reasonable proof of identity before processing a request concerning personal information.
This is intended to prevent personal information from being disclosed to an unauthorised person.
30. REFUSAL OF REQUESTS
Contenva may refuse or limit a request where permitted or required by applicable law.
Where appropriate, Contenva will explain the basis for the refusal and advise the requester of applicable complaint or review mechanisms.
31. PAIA
POPIA operates alongside the Promotion of Access to Information Act 2 of 2000 (“PAIA”).
Where applicable, requests for access to records held by Contenva may be handled under PAIA.
The Information Regulator has responsibility for both POPIA and PAIA and provides resources concerning PAIA manuals and access requests.
Contenva should maintain and make available an appropriate PAIA Manual where legally required.

- immediately notify Contenva of suspected unauthorised access.
42. DATA MINIMISATION
Contenva will seek to collect only personal information that is reasonably necessary for a specified and lawful purpose.

43. PURPOSE LIMITATION
Personal information collected for one purpose will not be used for an unrelated purpose unless the further processing is permitted by POPIA or another lawful basis applies.
44. THIRD-PARTY DISCLOSURES
Contenva does not sell personal information as a business practice.

You may unsubscribe from marketing communications by:
- clicking the unsubscribe mechanism provided in the communication;

- changes to our processing activities.
The latest version will be published on the Contenva website.
52. ACCEPTANCE
By using Contenva’s website or voluntarily providing personal information to Contenva, you acknowledge that you have had an opportunity to read this Privacy and Personal Information Processing Policy.
Where POPIA requires consent, this policy does not itself replace the requirement to obtain valid consent.
Consent will be obtained separately where necessary.
53. GOVERNING LAW
This Policy is governed by the laws of the Republic of South Africa.
The principal legislation governing personal information addressed by this Policy is:
- Protection of Personal Information Act 4 of 2013;
- Regulations relating to POPIA;
- Promotion of Access to Information Act 2 of 2000;
- Electronic Communications and Transactions Act 25 of 2002;
- Consumer Protection Act 68 of 2008; and
- other applicable South African legislation.
The POPIA Act and regulations should be read together with applicable regulatory guidance. The Department of Justice and Information Regulator publish the relevant legislation and regulations.
54. CONTACT CONTENVA

55. POPIA COMPLIANCE STATEMENT
Contenva is committed to protecting the privacy, confidentiality and security of personal information entrusted to it.
We will seek to:
- process information lawfully;
- collect information responsibly;
- use information for legitimate purposes;
- maintain information quality;
- limit unnecessary collection;
- protect information against unauthorised access;
- manage third-party processors responsibly;
- respect data-subject rights;

- cooperate with the Information Regulator where required.
56. IMPORTANT IMPLEMENTATION NOTICE FOR CONTENVA
Putting this page on Contenva.co.za is only one part of POPIA compliance. It does not by itself make the business fully POPIA compliant.
For Contenva specifically, I would implement these additional items:
| Area | Contenva should have |
|---|---|
| Privacy Policy | This page |
| PAIA | PAIA Manual |
| Information Officer | Registered with Information Regulator |
| Data inventory | Record what Contenva collects and where it goes |
| WooCommerce | Privacy/retention settings configured |
| Payment gateways | Privacy + operator/processor review |
| WordPress | Security and access controls |
| Cookies | Cookie disclosure/consent mechanism where required |
| Marketing | Consent + unsubscribe system |
| POPIA-compliant mailing lists | |
| Appropriate customer communication controls | |
| AI | AI/data-processing rules |
| Third parties | Operator/data-processing agreements |
| International services | Section 72 cross-border assessment |
| Data requests | Internal access/correction/deletion process |
| Breaches | Written security-compromise response procedure |
| Children | Children’s information procedure |
| Special information | Special personal information procedure |
| Retention | Data-retention schedule |
| Security | Technical and organisational safeguards |
| Training | POPIA awareness for people handling personal information |
| Records | Processing/consent/incident records |
This is particularly important because the Information Regulator currently provides dedicated services for POPIA self-assessment, complaints, security-compromise reporting, prior authorisation and Information Officer registration.
One important point for your Contenva site
Because you are using WooCommerce + payment gateways + marketing/affiliate systems + analytics + potentially AI/automation, I would not simply paste a generic “POPIA policy” onto the website and consider the job finished.
The next step should be to create a Contenva POPIA Compliance Pack consisting of:
- Website Privacy Policy — the document above.
- POPIA Data Processing Register — exactly what Contenva collects, why, where it is stored and who receives it.
- PAIA Manual.
- Information Officer policy and contact procedure.
- Data Subject Access Request form.
- Correction/Deletion Request form.
- Marketing Consent & Opt-Out procedure.
- Security/Data Breach Response Policy.
- Third-Party Operator Agreement template.
- Cookie Policy + Cookie Consent wording.
- AI & Automated Processing Policy.
- Data Retention & Destruction Schedule.
- Children’s Personal Information Policy.
- Special Personal Information Policy.
- Cross-Border Data Transfer Policy.
- WooCommerce/WordPress POPIA configuration checklist.
That would give Contenva a much more complete compliance framework rather than just a privacy webpage.
The current Information Regulator also publishes official POPIA forms, including forms for objections, correction/deletion, direct-marketing consent, complaints, security compromises and prior authorisation.
This document is drafted for practical use and is not a substitute for advice from a South African attorney or privacy specialist who can verify Contenva’s exact legal entity, processing activities, contracts and technology providers
